If a person passes away before their legal matter comes to an end, the claim in some circumstance can continue with the legal representatives of the estate.
However this does limit the types of damages that may be claimed.
In this situation, you cannot claim damages as to the loss of earning capacity or future earnings related to the period after the persons death.
However you may still able to claim some damages, including;
- Medical and hospital expenses
- Funeral expenses
- Loss of earning capacity for period prior to death
- Damages for care provided prior to death
