Over recent years there has been a large decrease in negligence cases in court. This isn’t because there are less “accidents” or “injuries”, it’s because there has been an increase in the certainty around the outcome of cases which means more can now be settled out of court.

As the volume of cases decided in the courts increased, the outcome of future similar cases becomes more consistent and predictable. This has the effect of making settlement before court more of an option.

The appearance of a decrease in litigated cases should not discourage you from pursuing genuine claims.  Cases are being settled outside of court allowing individuals to receive compensation without needing to go through the litigation process.
